Now this is really difficult to believe, well ok, not really. Only in a sane world would you find this difficult to believe but Tubularsock likes the “ring” of THIS IS DIFFICULT TO BELIEVE.
A Federal Judge has ordered AN IMMEDIATE halt (11/9/15) to the NSA’s phone records collection program ruling that the program VIOLATES THE CONSTITUTION. And in his new ruling Judge Richard Leon contends that the government’s Constitutional violation is so egregious that it could not be allowed to stand another day.
Now that isn’t the difficult to believe part. After all the 4th Amendment does say:
The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.
As a reasonable person can read, this isn’t rocket science!
And this “victory” for your Constitutional Rights isn’t all that significant due to the fact that the NSA’s collection program is already set to end on November 29.
So what is so difficult to believe?
Well, this is not the first time that Judge Leon ruled that the collections program is unconstitutional. He ruled the same thing previously in 2013 and issued an injunction to halt the collection program.
But then he also issued a stay on that injunction, pending an appellate review.
It took until November 2014 for arguments to proceed in the appellate court, and it took that court until August of 2015 to issue its opinion—an opinion that came after lawmakers had already passed the bill to halt the program.
The appellate court decision was to reverse the lower court ruling that said the program likely violates the Constitution’s ban on unreasonable searches. (8/29/15)
The appeals court sent the case back for Judge Leon to determine what further details about the program the government must provide.
But THAT isn’t what is so difficult to believe.
What is so difficult to believe is that Judge Leon was surprised that the process took so long to provide a decision on the case. THIS SURPRISES A FEDERAL JUDGE?

That a sitting federal judge would be surprised by ANYTHING Amerika’s government does anymore, lawful and/or otherwise, is a surprise. However I think the real surprise is that a federal judge could be surprised. So and quite possibly, surprise might be the theme here and that’s no surprise at all.

I’m highly skeptical that NSA is going to follow a court order requiring them to discontinue surveillance activities. Historically they have considered themselves above the law. If we really want to unplug them, we’re going to have to go down to the Utah data center and cut off their electricity.

I believe cutting off the electricity in Utah was at least attempted some time ago but I guess it didn’t get even close to the switch. Don’t think that is going to happen.
But yes, laws are made for suckers not for the high and mighty.

Leslie it is even worse than you think. Federal Judges are appointed and Leon was appointed to his lifetime judicial post by George W. Bush in 2002. Tubularsock agrees it’s a big show but this judge has a history of political pay off judgements.

A lady told me the other day, “You know, I wish I had taped that meeting!” I said, “For twenty dollars, you got a tape of that meeting.” She handed me a dead president, I handed her a taped copy of the meeting. Now, imagine what my take is on any given week when several times a day, I hear, “If only I had taped that!” Music to my ears and an increased plumpness in my purse! And here in my state, it is a ‘one consent’ state meaning that the only consent necessary for me to legally tape conversations is MY consent and hell ya, I give MY consent, goddamn it! Sweet! LMAO!

Our world would be much simpler and better if (a) courts recognized and worked to overcome their own procedural issues and limitations; and (b) the legislative and executive branches paid more than lip service to the courts’ interpretation of the government’s limitations. One can hope that comes to pass one day but we’re not there yet.

It is truly a sad commentary on the American Legal System that we brag about all over the world as “a nation of laws and not of men” when it is so torked! Under the current mind set in this country Tubularsock finds ANY “coming to pass” to be very unlikely and the likelihood of “one day” coming is not going to happen.
