
Now this is really difficult to believe, well ok, not really. Only in a sane world would you find this difficult to believe but Tubularsock likes the “ring” of THIS IS DIFFICULT TO BELIEVE.
A Federal Judge has ordered AN IMMEDIATE halt (11/9/15) to the NSA’s phone records collection program ruling that the program VIOLATES THE CONSTITUTION. And in his new ruling Judge Richard Leon contends that the government’s Constitutional violation is so egregious that it could not be allowed to stand another day.
Now that isn’t the difficult to believe part. After all the 4th Amendment does say:
The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.
As a reasonable person can read, this isn’t rocket science!
And this “victory” for your Constitutional Rights isn’t all that significant due to the fact that the NSA’s collection program is already set to end on November 29.
So what is so difficult to believe?
Well, this is not the first time that Judge Leon ruled that the collections program is unconstitutional. He ruled the same thing previously in 2013 and issued an injunction to halt the collection program.
But then he also issued a stay on that injunction, pending an appellate review.

It took until November 2014 for arguments to proceed in the appellate court, and it took that court until August of 2015 to issue its opinion—an opinion that came after lawmakers had already passed the bill to halt the program.
The appellate court decision was to reverse the lower court ruling that said the program likely violates the Constitution’s ban on unreasonable searches. (8/29/15)
The appeals court sent the case back for Judge Leon to determine what further details about the program the government must provide.
But THAT isn’t what is so difficult to believe.
What is so difficult to believe is that Judge Leon was surprised that the process took so long to provide a decision on the case. THIS SURPRISES A FEDERAL JUDGE?
